Notice: Tentative PY 2021 EHB Complaint Filing Deadlines

The Ohio Department of Insurance (ODI) has received questions regarding the deadlines for form, rate and QHP Binder filings that support the 2021 EHB compliant plans as well as the 2020/2021 school year student health plans.  As you know, the Department of Health and Human Services (HHS) has not yet finalized the HHS Notice of Benefits and Payments Parameters for 2021 Rule nor the 2021 Letter to Issuers.  As a result, ODI has not finalized its applicable deadlines.  However, ODI is releasing the following tentative state deadlines.

These tentative state filing deadlines apply to forms, rate and binder filings (if applicable) for (1) student health plans, (2) both on-exchange and off-exchange major medical plans and (3) both on-exchange and off-exchange certified Stand Alone Dental Plans (SADPs).

The tentative filing deadlines are as follows:

  • March 2
    • Student health plan form filings
  • March 25
    • All student health plan rate filings
  • April 29
    • All individual and small group, major medical form filings.  This includes all amendments, endorsements, riders and new forms that will be used in 2021.
  • May 11
    • All binder submissions for on-exchange major medical plans and SADPs that are on-exchange and/or off-exchange certified
  • May 18
    • All SADPs that are on-exchange and/or off-exchange certified form and rate filings and finalized SADP Binder Rate Date Templates
  • June 29
    • All individual and small group, on-exchange, major medical rate filings and finalized Major Medical Binder Rate Data Templates
  • July 17
    • All individual and small group, off-exchange, major medical rate filings
  • September 5
    • All large group, major medical rate form and rate filings

ODI will release final deadlines once HHS finalizes the Notice of Benefits and Payments Parameters for 2021 Rule and the 2021 Letter to Issuers.
